Patient Acknowledgment and Agreement

As a patient/caregiver of Fluresh Provisioning Center (the “Provider”), I declare by ordering online that each of the following statements are precise, accurate, and legally binding.

I am a “registered qualifying patient/caregiver” as defined by the State of Michigan’s Medical Marijuana Program (“MMMP”). I understand, comply, and agree to all the requirements, conditions, terms, and regulations of the MMMP.

I am over the age of 18 and will present a valid government issued identification card.

I understand that weapons and/or firearms are strictly prohibited on Provider property.

I understand and agree to comply with MMMP regarding the use of marijuana including, but not limited to ensuring all medical marijuana obtained from the Provider will be used only for the purpose as administered by a qualifying physician. Further, I hereby release and waive all claims against Provider from any and all liability related to my use of marijuana.

I agree that all marijuana purchased will not be distributed, resold, or possessed by any other person besides the registered qualifying patient.

I will store marijuana products in a safe, secure area out of reach of children and pets.

I understand that may be unlawful to possess, transport, or use marijuana outside the State of Michigan.

I understand that marijuana possession and use is illegal under U.S. federal law and that marijuana has not been analyzed or approved by the U.S. Food and Drug Administration or any other such agency. Therefore, the production of marijuana is not subject to any federal standards, quality control, or other federal oversight.

I understand that consumption of marijuana on Provider property is strictly prohibited.

I am aware of and have been advised by my qualifying physician, on side effects and risks associated with consuming medical marijuana and assume all risk related thereto. I also understand that there is limited information on the side effects of marijuana and its interaction with other substances, including prescription and nonprescription drugs, and alcohol.

If pregnant and/or breastfeeding, I am aware of and assume all risk and liability associated with the use of medical marijuana products.

I understand that the Provider is not a physician and is not providing medical advice.

I understand that some cannabinoids are considered intoxicants, and the consumption of marijuana may affect my consciousness, including but not limited to altered cognition, coordination, and/or judgement. These effects may alter the ability to drive, operate machinery, or any other dangerous/hazardous activity. I am aware that driving while impaired is dangerous and illegal. I will refrain from performing dangerous/hazardous activities while under the influence of marijuana.

I understand that my Personal Health Information (“PHI”) and medical records, both paper and electronic, are covered by the Health Insurance Portability and Accountability Act (HIPAA).

I agree to allow the Provider to share my data with Spring Big to utilize the loyalty program with knowledge that my personal data will never be sold or utilized by a third party in contravention of applicable laws.

I agree that any breech or violation of this agreement or any provisioning center rules may result in termination of this agreement and/or a ban from all Provider property.

I understand that the Provider is provisioning product to me in reliance on my declarations herein and shall hold Provider harmless of any criminal, civil, or personal liability related to my consumption or use of marijuana.
