To help clarify the whole Legal Cannabis tax charges; Cannabis is now legal for everyone over 21 in California, which means unavoidable taxes whether you have a med card or not. Medical card holders get a significant tax advantage; up to 10% off retail marijuana. A Medical Marijuana Identification Card (MMID) card exempts you from "sales and use tax" for one year. Depending on your location, sales and use taxes are 7% to 10% of the total transaction (including other taxes!) In all, there are three types of California cannabis taxes. The other two, another 15% or cannabis or more, cannot be avoided whatsoever! The three types of cannabis tax are, Excise Tax, Local Tax and Sales and Use Tax. Excise Tax is state tax that is tied to the wholesale price, and comes out to 15% of retail. This cannot be avoided!! Local Tax Ranges 0 tax to as much as 10% to 15 %. This tax is calculated from the total combined retail price and excise tax. Sales and Use tax are also a state tax, "sales and use" with rates starting at 7.25% through-out California, but go up to 10% or more as as jurisdictions add the "district" taxes, some of them even overlapping.it is calculated upon the combined total of retail price, excise tax AND local tax . However, if you have a (MMID) card you are not obligated to pay this.
